2. Our services; website is informational

Spot On Pest Control provides residential and commercial pest control services in East Texas. Those services are provided subject to a written service agreement or proposal you receive before work begins; if these Terms conflict with a signed service agreement, the service agreement controls for the services it covers. This website is provided for general informational purposes — descriptions of pests, treatments, plans and coverage on the site are summaries only and do not create a contract for services. Structural pest control services in Texas are regulated by the Texas Department of Agriculture's Structural Pest Control Service; our license (License #805260072) and licensing details are available on request.

3. Estimates & pricing

Prices, plans, promotions and service descriptions shown on this website, and any quote provided online or by phone before an on-site evaluation, are good-faith, non-binding estimates based on the information available at the time. Final pricing, scope and scheduling are confirmed in your signed service agreement or written proposal before work begins. Property conditions discovered on site — including the extent of an infestation, structural or moisture conditions, or accessibility issues — may change the scope or price. Promotions may be modified or withdrawn at any time, and service availability varies by location within our East Texas service area.

4. Scheduling & cancellation

Appointment times are scheduled in good faith and may be affected by weather, traffic, emergencies or job-length variations; we will communicate with you if a visit needs to be rescheduled. If you need to cancel or reschedule, please give us as much notice as practicable by calling (936) 632-6464. Any cancellation terms, fees or notice requirements that apply to recurring service plans are stated in your service agreement. Please secure pets and provide reasonable access to the areas to be treated at the scheduled time.

5. Satisfaction guarantee

We stand behind our work with a 100% satisfaction guarantee on every service we provide — if pests return between scheduled treatments covered by your plan, contact us and we will make it right as described in your plan. Statements on this website about guarantees, warranties, re-service or termite coverage are summaries only; the specific terms, conditions, exclusions and any coverage limits of the guarantee are governed by your written service agreement and any warranty documents you receive.

6. Website use & acceptable use

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, or restrict the use and enjoyment of, anyone else. TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) Spot On Pest Control AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THIS WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THIS WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). LIABILITY RELATING TO PEST CONTROL SERVICES IS ADDRESSED IN YOUR WRITTEN SERVICE AGREEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PORTIONS OF THIS SECTION MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend and hold harmless Spot On Pest Control and its owners, employees and agents from and against any claims, damages, losses and expenses (including reasonable attorneys' fees) arising out of your misuse of the website, content you submit, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Dispute resolution; governing law & venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us at [email protected] and give us 30 days to work in good faith to resolve the dispute informally. Any court proceeding arising out of or relating to these Terms or this website will be brought exclusively in the state or federal courts located in Angelina County, Texas, and you consent to their jurisdiction and venue.

By submitting a form on this website, or by calling or texting us, you consent to be contacted by Spot On Pest Control by phone, text message (SMS) and email about your inquiry, quotes, appointments and service. Message frequency varies; message and data rates may apply. Opt out of texts at any time by replying STOP, get help by replying HELP, and unsubscribe from marketing emails via the unsubscribe link in any message. 15. Severability; waiver; entire agreement

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remainder stays in full effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy and any written service agreement, are the entire agreement between you and the Company regarding the website.
